• GAME OPEN TO RESIDENTS OF THE 50 UNITED STATES AND D.C., 6-15 YEARS OF AGE AT TIME OF ENTRY WHO ARE MEMBERS OF THE BACKYARD SPORTS ALL-STAR TEAM OR WHO PROVIDE US WITH A VALID PARENT EMAIL ADDRESS. SEE BELOW FOR ADDITIONAL ELGIBILITY RESTRICTIONS.  THERE IS NO COST OR OBLIGATION TO BECOME A MEMBER OF THE BACKYARD SPORTS ALL-STAR TEAM. HERE'S HOW TO PLAY: Starting at 12:01 a.m. Eastern Daylight Time (EDT) on 5/1/08, and continuing through 11:59 p.m. EDT on 8/1/08 (the "Promotion Period"), log on to www.backyardsports.com and follow the on-screen instructions to register as a member (or sign in if you are already a member) and then enter the sweepstakes. If you do not wish to join our club you may simply provide us with your parent’s email address. Once you register for the club or enter the sweepstakes, you are entered to win a chance to meet David “Big Pappi” Ortiz. If you win you will have the opportunity to have an exclusive meet-and-greet with David Ortiz (note: this may include some or all of the following: an opportunity to receive an autograph, have a photo taken and a brief meeting). You may come back to enter the sweepstakes once per day during the Promotion Period. There is a limit of one entry per day, and you are only eligible to win one prize for the entire Promotion Period. Grand Prize must be claimed by 8/30/08, and you must be able to travel to one of the markets in which David Ortiz has scheduled games during the month of September. or prize will be forfeited and may be awarded to an alternate winner, time permitting. Other prizes must be claimed by 9/1/07, or prize will be forfeited and may be awarded to an alternate winner. Normal Internet charges, if any, charged by your Internet service provider, will apply. IMPORTANT NOTE: Winners of the Sweepstakes will be selected in a random drawing conducted by Access Marketing Services, LLC on or about 8/15/08 from among all eligible entries received. Odds of winning will depend on the number of eligible entries received. Winner of the Sweepstakes will be notified by phone, mail, and /or e-mail.
• PRIZES, APPROX. RETAIL VALUES (ARV): 1 prize with a total approximate retail value of $3,500 will be available to be won as follows: Trip for two to meet David “Big Papi” Ortiz, during the month of September 2008 including round-trip coach air transportation for two from a major airport nearest the  winner's home town to the selected city where David Ortiz is playing (if the winner lives within 100 miles of the selected city, winner will receive limo transportation in lieu of airfare and the difference in value will not be awarded), 1 hotel room with double occupancy accommodations for 2 nights, and $500 spending money (for winner only). (ARV: $3,500 ). No cash substitutions will be made if the winner cannot claim the prize.  The actual retail value of the trip will depend on point of departure/return and airfare fluctuations. All meals, taxes, incidental hotel expenses and gratuities, and any other expenses not specified herein are the responsibility of the winner. Winner must be accompanied by a parent or legal guardian. Limit one prize per person/e-mail and residential address for the entire Promotion Period.
• ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia only, ages 6 through 15 at time of entry who are members of the Backyard Sports All-Star Team or provide us with their parents email address. Employees of Humongous, Inc, its distributors, retailers, subsidiaries, affiliates, advertising, promotion and Internet agencies, the judging organization and the family members and/or those living in the same household of each are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law.
• INTERNET ENTRY: Sponsor is not responsible for incomplete, lost, late, damaged, illegible or misdirected e-mail or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry (i.e., the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address). Sponsor reserves the right, in its sole discretion, to cancel or suspend this sweepstakes and award all unclaimed prizes via the second-chance method of entry should a virus, bugs, or other causes beyond the control of the Sponsor corrupt the administration, security or proper operation of the sweepstakes. Sponsor reserves the right to modify or terminate the sweepstakes if fraud, misconduct or technical failures destroy the integrity of the sweepstakes as determined by sponsors, in their sole discretion. In the event of termination, prizes will be awarded in a random drawing from eligible, non-suspect entries received prior to termination.
• GENERAL RULES: By participating in this promotion, entrants agree to be governed by these rules and by accepting prize, winners agree, if requested, to the use of their names and/or photographs without compensation for advertising purposes related to this promotion, except where prohibited. Prizes won by minors will be awarded to parent or legal guardian. Grand Prize winner, the parent/legal guardian who will be accompanying the minor on prize travel and other travel companions will be required to complete and return an affidavit of eligibility/release of liability and a publicity release (except where prohibited) within 10 days of attempted delivery of same. Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner selected. Prize winner's parent/legal guardian will be required to accompany him/her on trip and will be counted as a traveling companion. All travelers must possess required travel documents (e.g., valid photo ID) prior to departure. All travelers must agree to depart and return within the dates and at times specified by the Sponsor. Trip must be taken on dates specified by Sponsor.  Taxes on prizes are the sole responsibility of winners. No substitution or transfer of prize except as provided herein. No cash redemptions except as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value, should any prize or portion of prize become unavailable. Decisions of Access Marketing Services, LLC (the judges) are final in all matters, including winner verification. By accepting prize, winners agree to release and hold Humongous, Inc, its affiliates, subsidiaries, divisions, agents, officers, directors or employees and assigns, harmless from and against any and all claims and liability arising out of use of prize. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize.
