OFFICIAL RULES—“Hit a Homer with David Ortiz” Drawing Contest

NO PURCHASE NECESSARY TO ENTER OR WIN. MANY WILL ENTER, FEW WILL WIN.

1.  Contest Period:  The “Hit A Homer with David Ortiz” Drawing Contest presented by Backyard Sports (the “Contest”) starts May 1, 2008 and ends June 1, 2008 (the “Contest Period”).

2.  Eligibility:  Open to legal residents of the 50 United States and the District of Columbia between the ages of 8 and 11 at the time of entry who are enrolled at a participating school. Void where prohibited by law.

3.  How To Enter: Teachers, ask each student to draw a picture demonstrating something he/she could do with friends and family to make a difference or help the community. 

Drawings must be created by hand on an 8.5X11-inch or 9 X12-inch piece of paper. Please have each student include his/her full name, your name, and the name and address of your school on the back of his/her drawing. Each entry must also come with a completed and signed contest entry form securely attached. Submit your students’ drawings by mail to: “Hit a Homer with David Ortiz” Drawing Contest, P.O. Box 427, West Chester, OH 45071. Enclose a piece of paper with your name, the school’s name, address and phone number. Entries that do not include the required information will be disqualified.  Participation in this contest is subject to your school's policies. There is a limit of one (1) entry per student. Entries must be the original work of the student; may not have won previous awards; may not have been published previously; must not infringe third-party rights; and must be suitable for publication (i.e., may not be obscene or indecent).  Drawings that are deemed obscene, indecent or offensive in any way will be disqualified at the sole discretion of the Sponsor. 

4.  Deadline: Entries must be postmarked by June 5, 2008, and received by June 20, 2008.

5. Prizes and Approximate Retails Value (ARV): 

Student Prizes: Ten (10) Grand Prize Student Winners will receive a Tailgate Toss Game (ARV: $100). Fifty (50) Runner-Up Student Winners will receive the first book in Backyard Sports reading series -  Wild Pitch. (ARV. $4).Selected drawings may be featured at www.backyardsports.com.

Teacher Prizes:  Teachers who submit one of the top ten (10) student drawings will receive a set of four (4) Humongous Adventure Games featuring Freddi Fish, Putt Putt, Pajama Sam, and Spy Fox (ARV: $80).  All other teachers will receive a pack of 30 MLB pencils. (ARV $15).    

6.  Selection of Student Winners/Judging Criteria: All eligible entries received during the Contest Period will be judged by a panel of qualified judges based on the following equally weighted criteria: 1) originality and creativity; 2) artistic skill; and 3) demonstration of theme.  In the event of a tie, the tie will be broken based on the highest score in the first judging criteria, and if the tie is not broken, by the highest score in the second judging criteria. 

7.  Winner Notification: The potential winning teachers will be contacted by telephone and/or mail, between 2 and 4 weeks after the selection of the winners. Winning students will be required to complete a Liability/Publicity Release, within seven (7) days from the date of prize notification.  Failure to execute and return the required documents within the specified time period will result in the prize being forfeited and, at Sponsor’s discretion, awarded to an alternate entrant.

8.  Ownership/Use Of Entry: By submitting a drawing, student agrees to assign all rights to the drawing to Sponsor (including copyright and all right, title and interest therein) and to permit Sponsor and its designees to edit the drawing and to use and distribute it, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to you or any third party. Materials submitted in connection with the Contest will not be returned. 

9.  Release Of Liability: By participating in the Contest, students and teachers agree to (i) be bound by these Official Rules and the decisions of the Sponsor and Judging Panel, which are final and binding in all respects, and (ii) release and hold harmless the Sponsor, its parent, subsidiaries, and affiliates including, without limitation, Major League Baseball, Weekly Reader, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) from any liability, loss, damage, claims or expenses, personal injury, death or property damage arising out of the Contest, or the receipt, possession, or use or misuse of any prize, the use of drawings in any manner by Released Parties or any information displayed on any website in connection with this Contest and any claims based upon the right of publicity or invasion of privacy. By submitting an entry, students and teachers agree, and agree to confirm in writing (if requested), that Sponsor and its designees shall have the right to use your name, entry, likeness, voice, statements and biographical information, in connection with this Contest (including, without limitation, if you are a winner, announcing you as such on www.backyardpsports.com), and the advertising, marketing and promotion thereof, without additional compensation, notification or permission, except where prohibited by law. 

10.  Conditions of Entry: By submitting an entry, teachers and students (i) acknowledge compliance with these rules, including all eligibility requirements; (ii) agree to be bound by the decisions of the Sponsor and Judging Panel, which shall be final and binding in all matters relating to this Contest.

11. General Conditions: The submission of materials to Sponsor is solely the responsibility of the entrant. Contest entrants assume all risk of loss, damage, destruction, delay and misdirection of materials. Sponsor is not responsible for incomplete, illegible, misdirected, damaged, lost, or postage-due entries or mail. Proof of mailing does not constitute proof of delivery. Released Parties are not responsible for errors of any kind which may occur in connection with the administration of the Contest, or the processing or judging of entries.  Sponsor reserves the right, in its sole discretion to terminate, modify, cancel or suspend this Contest (or any portion thereof), should fraud, or any errors, or other causes beyond the control of Sponsor corrupt the administration, security or proper conduct of the Contest. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Ohio without regard to conflicts of law principles. All participants consent to the jurisdiction and venue of in Ohio.

11. Winner’s List Request: For the names of the winners, send a handwritten self-addressed postage stamped envelope to: “Hit a Homer with David Ortiz” Drawing Contest – Winners List, P.O. Box 427, West Chester, OH 45071, to be received by July 1, 2008.
